Sgt. Levy was mortally wounded at Malvern Hill, Virginia during the Seven Days Battles and died on July 4, 1862, in Richmond, Virginia. At Malvern Hill, the 3rd Alabama was commanded by Major Robert M. Sands and was assigned to Brigadier General Robert Rodes' Brigade of Major General D.H. Hill's Division. Malvern Hill was called the "fortress in the field," a plateau heavily defended by Union artillery batteries. The 3rd Alabama, under heavy fire, was ordered to charge and take the Union artillery battery in their front. The 3rd overran the first line of Union infantry but was stopped within 200 yards of the artillery. Major Sands reported the 3rd Alabama's casualties as 37 killed and 163 wounded, a total of 200 casualties out of the regiment's 354 soldiers at the Battle of Malvern Hill on July 1, 1862. His report is often cited by historians for reporting that six of his soldiers were "shot down while carrying the colors [the Battle Flag] forward." A seventh soldier brought back a shattered staff and fragments of the battle flag shredded by enemy fire. |
